Bipartisan Maine Bill Would Give Licensed Marijuana Cultivators 120-Day Grace Period for Excise Tax Payments

House Paper 1095 (LD 1654), sponsored by Representative David Boyer of Poland along with a bipartisan group of 11 other lawmakers, has been referred to both the House and Senate Taxation Committees.
Under current law, licensed cultivation facilities must submit monthly tax returns and pay all excise taxes due from sales made to other cannabis licensees during the prior month. This bill would extend that payment deadline to 120 days after the date of sale. If the cultivation facility also holds a license to operate another cannabis establishment, the 120-day countdown would begin on the date cannabis is transferred to that facility or on the date of certain activities authorized under state law, depending on the circumstances.
According to the bill’s summary, the change is designed to provide flexibility for growers who may not receive immediate payment or revenue from sales, giving them a financial cushion as they operate within Maine’s adult-use cannabis framework.
