Nebraska: Judge Dismisses Lawsuit Challenging Medical Marijuana Law

The lawsuit was filed by former State Senator John Kuehn (R), who argued that because marijuana remains illegal under federal law, the initiatives should be deemed unconstitutional. The suit named Governor Jim Pillen and Secretary of State Bob Evnen as defendants. The case was dismissed by Lancaster County District Court Judge Susan Strong, who ruled that the plaintiff, John Kheun, does not have standing. In the lawsuit, Khuen alleged that the measures were unconstitutional under both state and federal law.

Following the ruling, Nebraskans for Medical Marijuana (NMM) Executive Director Crista Eggers said “We appreciate the Court’s thoughtful decision to dismiss John Khuen’s latest lawsuit. This is yet another failed attempt to strip away the will of the people, and should send a clear message to the opposition that they have lost.”

He continued by saying “Many years of hard work have gone into this effort—from volunteers, patients, and families across the state. Today marks the reality that we will finally see the day that we, and all Nebraskans have fought for.”

Although the case has been dismissed, it could potentially be refiled in the future.
