Nebraska AG Files Lawsuit Against California-Based Cannabis Company Claiming Trade Law Violations

Nebraska Attorney General Mike Hilgers last week filed a lawsuit against Savage Enterprises – a Wyoming corporation based in California – claiming the company is violating Nebraska’s Consumer Protection Act and Uniform Deceptive Trade Practices Act with its THC products.  The lawsuit contends that Savage’s products’ packaging is designed to appeal to adolescents and teens; that the company’s social media ad campaigns on Instagram, YouTube, and Discord target youth “through the use of young-looking models and influencers;” that the products contain high levels of synthetically produced THC in forms that “are indistinguishable from common forms of children’s candy;” and that the packaging “misrepresents forms of THC that are present in the products and the concentrations” the products contain.

The lawsuit further alleges that Savage “has recklessly ignored the warning signs” of its products “by continuing to sell large volumes of products laced with extremely high concentrations of delta-8 THC (and other variants, equivalents, or analogues of THC) to retail smoke shops in communities throughout” Nebraska.

The lawsuit further claims that youth in Nebraska can easily purchase the products online.

“The sale of Savage Enterprises’ unsafe, untested, and unregulated THC products online is an especially egregious behavior that makes Savage’s THC-containing products incredibly easy for children and teens to acquire.” — The State of Nebraska v. Savage Enterprises

The Attorney General has also issued cease-and-desist letters to retailers in the state demanding that they stop selling Savage Enterprise products, noting that state law enforcement officials made purchases of products from these retail stores and that each store investigated had at least one product with a delta-9 concentration over the legal limit and had labels that incorrectly identified the content of the products.

The lawsuit seeks an injunction against the sale of Savage’s products in the state and to recover civil penalties and fees for violation of the Trade Practices Act. The lawsuit was filed in the District Court of Lancaster County.
