Massachusetts Bill to Allow Insurers to Offer Discounts for Marijuana Impairment Education Courses Scheduled for October 22 Public Hearing

The Joint Committee on Financial Services has scheduled a hearing on October 22, 2025, from 10:30 a.m. to 1:00 p.m. in Room A-1 to consider House Bill 1213, filed in February by State Representative Hannah Kane (R). The measure would allow motor vehicle insurance companies to offer discounts to drivers who complete an approved marijuana impairment education course. Given insurers cannot create new discount categories without explicit authorization or approval from the Division of Insurance, such a discount is not currently allowed. The bill directs that such courses could be offered through accredited driving schools or directly by insurance companies, subject to approval from the commissioner of insurance. Each program must include a module specifically addressing the dangers of driving under the influence of marijuana.
Representative Kane’s legislation has attracted bipartisan support, with cosponsors including Representatives Kimberly Ferguson (R), Patrick Joseph Kearney (D), John Marsi (R), Michael O. Moore (D), and Alyson Sullivan-Almeida (R).
The proposal mirrors a similar measure filed in the 2023–2024 session and reflects ongoing efforts to address concerns about impaired driving as marijuana use becomes more widespread. The upcoming hearing will give lawmakers, stakeholders, and the public an opportunity to weigh in on the proposal.
