Florida Representative Files Bill to Tighten Medical Marijuana Rules and Expand Health Programs

The 16-page measure makes targeted changes across multiple statutes, with some of the most notable updates focused on Florida’s medical marijuana system. Gerwig’s bill revises the definition of “low-THC cannabis,” updates requirements for physicians and medical directors who work in the medical marijuana program, and eliminates outdated language tied to earlier versions of the law. It also establishes new buffer-zone rules that bar medical marijuana treatment centers from placing cultivating, processing, or dispensing facilities within 500 feet of parks, child-care facilities, early learning centers, or K-12 schools. Existing facilities approved before July 1, 2026, would be exempt.

Under the bill, local governments would be authorized to approve a dispensing location within the restricted distance if it is determined to benefit community health and safety.

The bill also updates the Dental Student Loan Repayment Program by redefining “low-income” and revising eligibility rules for dentists and dental hygienists. It removes the previous definition of “medically underserved area” and adjusts volunteer service requirements for participants.

Gerwig’s proposal makes substantial changes to the Early Steps Program, Florida’s early-intervention system for infants and toddlers with disabilities. It updates the Department of Health’s duties, standardizes statewide transition procedures for children entering school district programs, and aligns related statutes with federal IDEA requirements.

Another provision mandates immediate emergency license suspension for any health care practitioner arrested for murder or related offenses. The legislation also expands eligibility for a University of Florida autism micro-credential program, adding Early Steps providers and outlining competency requirements and stipend eligibility for participants.

If enacted, the bill would take effect July 1, 2026.
