Tennessee Bill Would Raise Low-Level Marijuana Possession Threshold From Half-Ounce to Five Ounces

A proposal filed today by State Senator Raumesh Akbari (D) would dramatically change how marijuana possession is treated under Tennessee law by increasing the amount considered a low-level offense from one-half ounce to five ounces. Senate Bill 2095 amends multiple sections of Tennessee Code Annotated Title 39, Chapter 17, which governs drug offenses. Under current law, possession of more than 14.175 grams (one-half ounce) can trigger more serious criminal penalties. The legislation would replace that threshold with 141.748 grams, or five ounces, across the relevant statutes.

The bill would also revise the penalty structure for possession. While possession of marijuana would remain a Class A misdemeanor, the measure creates a specific fine schedule for those found with less than five ounces. A first offense would carry a $500 fine, while second or subsequent offenses would result in a $1,000 fine.

By updating the quantity referenced in multiple sections of state law, the proposal effectively broadens the range of what Tennessee treats as minor possession, reducing the legal risk for individuals carrying amounts well above the current half-ounce standard.

If enacted, the changes would take effect July 1, 2026.
