Smart & Safe Florida Surpasses 714,000 Valid Signatures for 2026 Recreational Marijuana Initiative

According to new data from the Florida Division of Elections, Smart & Safe Florida has now submitted over 714,000 valid signatures for its constitutional amendment to legalize recreational cannabis, which it’s trying to place on the 2026 ballot. In total, the group has submitted 714,888 statewide valid signatures as of the latest update. That total places the campaign within striking distance of the 880,062 signatures required to secure a ballot position for the 2026 general election, although the February 1 deadline is fast approaching.

The proposal would amend Article X, Section 29 of the Florida Constitution to allow those 21 and older to possess, purchase, and use marijuana for non-medical purposes. It would allow those 21 and older to possess up to 2.5 ounces of marijuana, 8 grams of concentrated cannabis, and cannabis paraphernalia for personal use. The proposal would prohibit marketing and packaging attractive to children, ban public smoking and vaping, and keeps in place existing prohibitions on driving under the influence.

The measure would allow existing Medical Marijuana Treatment Centers to acquire, cultivate, process, transport, and sell marijuana to adults, while creating a framework for the licensing of non-medical marijuana businesses.

Smart & Safe Florida said in November that they’ve collected over one million signatures, indicating they likely possess signatures that have not yet been submitted.
