Congress Now Has 34 Marijuana and Hemp Measures Pending, Here’s a Breakdown of Each

The 119th Congress now has 34 standalone marijuana, hemp or cannabinoid-focused bills pending.

The list has grown since our previous roundup a month ago, with lawmakers introducing a House companion to the CLAIM Act and a new bipartisan bill addressing federal employment and security clearances for people with a history of marijuana use. Several existing proposals have also gained additional sponsors.

The list below is ranked by the total number of current sponsors, including the primary sponsor and all current cosponsors. When identical or substantially identical companion bills have been introduced in both chambers, their support is combined.

Annual appropriations bills and broader legislation that only contains marijuana or hemp provisions as part of a much larger package are not included.

The Marijuana Opportunity Reinvestment and Expungement (MORE) Act would remove marijuana from the federal Controlled Substances Act, eliminate federal criminal penalties for marijuana possession and establish procedures for expunging or resentencing certain federal marijuana convictions. It would also establish programs intended to address the effects of marijuana prohibition.

The Hemp Planting Predictability Act would delay implementation of federal changes to the definition of legal hemp, giving the industry additional time before restrictions targeting certain hemp-derived cannabinoid products take effect.

The House version has substantially more support than its Senate companion.

The SAFE Banking Act would protect banks, credit unions and other financial institutions from federal penalties for providing services to state-legal marijuana businesses and businesses that serve the marijuana industry.

The proposal is intended to expand access to banking, lending, payment processing and other traditional financial services for marijuana companies.

The Cannabis Administration and Opportunity Act would remove marijuana from the Controlled Substances Act and establish a federal regulatory and taxation framework for legal marijuana.

The legislation also includes provisions involving expungement, resentencing, federal benefits and reinvestment in communities disproportionately affected by marijuana prohibition.

The No Deductions for Marijuana Businesses Act would prevent marijuana businesses from claiming ordinary federal business tax deductions even if marijuana is moved to a less restrictive schedule under federal law.

The legislation would effectively preserve the tax treatment currently imposed on marijuana businesses under Section 280E of the Internal Revenue Code.

The RESPECT Resolution is a nonbinding House resolution urging federal, state and local governments to take a series of steps addressing the consequences of marijuana prohibition, including expungement and criminal justice reforms.

Unlike the other measures on this list, the resolution would not make statutory changes if approved.

The Strengthening the Tenth Amendment Through Entrusting States 2.0 Act would exempt people and businesses acting in compliance with state or tribal marijuana laws from most federal marijuana enforcement.

The legislation would also address interstate marijuana commerce and federal taxation and regulation of legal marijuana activity.

The Lawful Hemp Protection Act would establish a federal framework for hemp-derived cannabinoid products while targeting high-THC synthetic intoxicants.

The measure includes provisions involving manufacturing, testing, taxation and consumer protections while seeking to preserve a legal market for qualifying hemp-derived products.

The Hemp Enforcement, Modernization, and Protection (HEMP) Act would establish federal standards for cannabinoid hemp products, including requirements involving manufacturing, testing, labeling and marketing.

The proposal would also establish a minimum age of 21 for certain cannabinoid products and give the Food and Drug Administration a larger regulatory role.

The Capital Lending and Investment for Marijuana Businesses (CLIMB) Act would protect financial institutions and other businesses that provide capital, investment and certain professional services to state-legal marijuana companies.

Among other changes, it is designed to improve marijuana companies’ access to investment markets and financial services.

The Marijuana in Federally Assisted Housing Parity Act would prevent people from being denied federally assisted housing solely because they use marijuana in compliance with state law.

The legislation would also require marijuana smoking restrictions in federally assisted housing to generally be treated in a manner comparable to tobacco smoking restrictions.

H.R. 7010, which does not have a formal short title, would delay implementation of federal changes to hemp law enacted in 2025.

The measure would extend the implementation period from one year to three years, giving hemp businesses and regulators additional time before the new restrictions take effect.

The Veterans Equal Access Act would allow Department of Veterans Affairs health care providers to discuss marijuana with veterans and complete state medical marijuana recommendation forms in jurisdictions where medical marijuana is legal.

Current federal VA policy restricts clinicians from formally recommending marijuana even in states with legal medical programs.

The Beverage Regulatory Parity Act would establish a separate federal regulatory framework for qualifying hemp-derived THC beverages.

The measure includes manufacturing, distribution, labeling and advertising requirements, establishes a minimum purchase age of 21 and imposes a federal excise tax based on the amount of intoxicating THC in a beverage.

The Preparing Regulators Effectively for a Post-Prohibition Adult-Use Regulated Environment (PREPARE) Act would establish a federal commission tasked with studying and recommending a regulatory framework for marijuana if federal prohibition ends.

The commission would examine issues including federal and state regulatory responsibilities, taxation, public health, criminal justice and the transition to a legal national market.

The Establishing and Developing University Cannabis Agriculture Techniques and Excellence (EDUCATE) Act would establish a federal marijuana agricultural research program at eligible institutions, including historically Black land-grant universities.

The measure is intended to expand academic research, education and workforce development involving marijuana cultivation and processing.

The American Hemp Protection Act would repeal federal hemp restrictions enacted in 2025 that narrow the definition of legal hemp and restrict certain cannabinoid products.

The proposal would effectively reverse those changes before they take effect.

The Marijuana 1-to-3 Act would direct the federal government to move marijuana from Schedule I to Schedule III of the Controlled Substances Act.

Unlike legislation that would deschedule marijuana entirely, the proposal would maintain marijuana’s status as a federally controlled substance while placing it in a less restrictive category.

The Clarifying Law Around Insurance of Marijuana (CLAIM) Act would protect insurers from federal penalties for providing insurance coverage and related services to marijuana businesses operating legally under state or tribal law.

A bipartisan House companion was introduced in September, expanding the proposal to both chambers of Congress.

The Marijuana Impact on Medicaid Act would require the Department of Health and Human Services to collect data and report to Congress on Medicaid costs associated with certain marijuana-related hospital and emergency department visits.

The required report could also include recommendations for legislative or administrative changes.

The Cannabinoid Safety and Regulation Act would establish a federal regulatory framework for hemp-derived cannabinoid products.

The measure addresses areas including product testing, manufacturing, labeling, packaging and age restrictions while giving federal regulators authority over the cannabinoid market.

The Veterans Cannabis Use for Safe Healing Act would prohibit the Department of Veterans Affairs from denying benefits to veterans solely because they participate in a state-legal medical marijuana program.

It would also protect veterans’ ability to discuss marijuana with VA health care providers and receive relevant information in states where marijuana is legal.

The Cannabis Users’ Restoration of Eligibility (CURE) Act would limit the federal government’s ability to deny security clearances or federal employment suitability determinations solely because of an applicant’s past marijuana use.

The bipartisan proposal was introduced in September and has already gained an additional cosponsor since its filing.

The Hemp Safety Enforcement Act would give states and tribes additional authority over hemp production and allow jurisdictions to opt out of portions of the federal hemp framework.

The measure is sponsored by Senator Rand Paul (R-KY), with Senator Amy Klobuchar (D-MN) as its current cosponsor.

The Higher Education Marijuana Research Act would make it easier for colleges and universities to conduct marijuana research.

The legislation would allow qualifying institutions in legal jurisdictions to obtain marijuana from state or tribal regulatory bodies or law enforcement for research while protecting participating institutions and researchers from losing federal funding solely because of that work.

The Small and Homestead Independent Producers Act would allow qualifying small marijuana cultivators and product manufacturers to ship marijuana and marijuana products in jurisdictions where such activity is legal.

The legislation would authorize shipments through the U.S. Postal Service and certain private carriers while imposing age-verification and other requirements.

The Evidence-Based Drug Policy Act would repeal a federal requirement that the Office of National Drug Control Policy oppose efforts to legalize controlled substances, including marijuana, that have not been approved for medical use by the Food and Drug Administration.

Supporters argue the existing provision unnecessarily requires the federal drug-policy office to advocate against legalization regardless of evolving state laws or evidence.

The Hemp Economic Mobilization Plan Act would raise the federal THC threshold for legal hemp from 0.3% to 1%.

The measure would also make other changes to federal hemp testing and enforcement requirements intended to reduce the risk that farmers inadvertently produce crops exceeding the legal THC limit.
